病気やケガで休職している従業員の休職期間が満了した場合、その従業員を復職させるのか、自然退職とするのか、会社は判断をしなければなりません。
勿論、休職期間満了前に傷病から回復（治癒）していれば復帰となりますが、回復せずに休職期間満了となれば自然退職となります。
復職の要件となる「治癒」は、原則として「従前の職務を通常の程度行える健康状態に復したとき」とされています。従って、病気はほぼ治ったが仕事ができないようであれば、復職を認めないことができますが、休職前と同じ負荷の仕事はできないが、しばらく軽易な業務に就かせれば、ほどなく通常の業務に復帰できるようであれば、会社側が配慮しなければならない場合もあります。
復職の可否は、会社が最終的に決めるものなので、実際に従業員が就労可能な状態まで回復したかどうかは、会社側で十分調査し、判断することが必要です。
復職の際には、病気が本当に治ったのか、医師の診断書が重要な参考資料になります。ただ、診断書には一般的に短い文章で「復職可能なまで回復した」ということまでしか書かれていないことが多く、病気は大体治ったが、本当に勤務が可能なまでに回復したのか、判断に困ることが多いようです。
診断書を書いた医師も、その従業員が会社でどんな仕事をしているのか、会社の仕事の内容を完全に把握したうえで診断書を書いているわけではないようです。
会社側としては、診断書を発行した医師と面談し事情を聴取したり、会社指定の医師の診断を受けさせるなどの対応が必要となります。
休職していた従業員が本当に復職可能か、診断してくれる医師を会社側としては、あらかじめ探しておくことが大事です。
復職可能かどうかの最終判断は、あくまで会社で行ってください。
